The Volume Is Turned Up and Yet
No One Hears You?

Nothing is more frustrating on a project than following the conditions of contract and either not receiving a response or being told there is ‘no change’ or ‘no additional entitlement’. In many cases, this is a simple lack of understanding in whether the original scope has changed. In other situations, this is clearly gamesmanship and a hope that the change will be dropped or horse-traded collectively at the end of the project. A contract provides legally binding obligations and simply to stop or refuse to deliver contracted works in an attempt to agree valid entitlement, is equally wrong if not worse.

ReSolv3D® are able to assist in resolving disagreements, mediating between parties and structuring arguments in the right way with the right level of detail and supporting evidence. On even the best managed projects, there are differences of opinion. In a competitive industry, relationships and repeat business is key, and how you manage such differences of opinion can determine future opportunities. We remain professional; try not to make disagreements personal (although we do understand this is your money); and maintain integrity which remains at the very core of our values.

Despite the contract conditions, agreements and changes can be made amicably if all parties are in agreement. As such, we will always advise and attempt to mediate between parties to avoid formal dispute resolution. As a difference of opinion, becomes a disagreement, and progresses to a dispute; so, the escalation of frustration and costs also increase. This is not to say your entitlement should not be protected and pursued where necessary, but a realisation that formal disputes cost time and money. Sometimes this is not just measured in direct currency, but through reputational damage. Inevitably, formal dispute resolution never covers the true value being sought. If an amicable agreement or settlement can be reached, we would strongly recommend this is investigated.
