The Project Is in Delay, Resources Have Increased, Costs Have Gone Up –
How Has This Escalated So Quickly?

It is all too common practice to be amenable and accommodating at the start of the project. Relationships are import, so why rock the boat and be seen too contractual before the scheme has even started? Is it a problem that contract award is 4-weeks later than planned, or access to part of the site is delayed through other works or access agreements not being in place? It hardly seems a concern at the start of a two-year scheme.

However, when client costs have increased, budgets stretched, and the project completion is delayed by 4-weeks – will the client levy those 4-weeks delay damages at £50k per week? It might not be up to the friendly client team whom you share a sandwich with on a Friday. In an ideal world, such events and delays will be recorded contemporaneously even if costs and time are not formally claimed at that juncture.
The contract exists to protect everyone, and the above example is relatively simple. However, complex delays involving numerous items of change to scope, new drawings, weather effects, consequential delay, loss of production, under performance, simultaneous delay, or design development – these are all areas that can compound over time and cause irreversible delay. Unfortunately, too often change cannot be agreed with the client; as works progress and as costs or delay mount up, the client becomes less amenable to agree further change. ReSolv3D® can assist you piece together and analysis the chronological effects on the project, who is responsible for change and structure programmes, narrative and reports to assist in the recovery of time and costs.

We can forensically analyse the information, project communications and programme updates and compile documents that can be used to support a claim or formal dispute resolution. We can produce time slice programmes showing how each change had an effect or consequential effect on the overall programme. Where possible we will try to demonstrate under the contract where entitlement is due.
